PHC Drops KP Emergency Petitions From Cause List

The Peshawar High Court has removed all petitions challenging the emergency and governor's rule in Khyber Pakhtunkhwa from its cause list, in the latest twist in the legal battle over the province's constitutional crisis.
The move came on Saturday, 7 November, a day after the Federal Constitutional Court stripped the high court of jurisdiction over cases in the province filed after 12 October. Petitions against arrests under the Maintenance of Public Order ordinance were also removed from the list.
According to reports, the high court's Administrative Committee issued a notification directing that no writ petitions filed on or after 12 October be fixed for hearing. Petitions filed under Article 199 of the Constitution are to be returned to the petitioners, who have been advised to approach the appropriate forum for relief. New petitions will not be received or entertained at the filing counter.
Among the petitions removed were those seeking the recovery of Khyber Pakhtunkhwa Chief Minister Sohail Afridi, Provincial Assembly Speaker Babar Saleem Swati and the PTI's provincial president Junaid Akbar. The challenges to the emergency and governor's rule had been filed by PTI Chairman Barrister Gohar Ali Khan, National Assembly Opposition Leader Mahmood Khan Achakzai, the Khyber Pakhtunkhwa Bar Council, NDM Chairman Mohsin Dawar and MNA Shandana Gulzar.
The emergency and governor's rule were proclaimed on 11 October, when President Asif Ali Zardari approved the prime minister's advice under Articles 232 and 234 of the Constitution. The Federal Constitutional Court had ruled on 5 November that, because the armed forces had been called in aid of civil power under Article 245, proceedings on Article 199 petitions filed on or after 12 October stood suspended.
